TOWN OF EAGLE, COLORADO ORDINANCE NO. 37 (Series of 2018) AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF EAGLE, COLORADO AMENDING SECTION 3.04.066 OF THE EAGLE MUNICIPAL CODE TO INCREASE THE SALES TAX ON RETAIL PURCHASES OF MARIJUANA AND MARIJUANA PRODUCTS FROM 2.5% TO 3.0% WHEREAS, at the coordinated election held on November 7, 2017, the Town's electors approved the levy of a special sales tax on the sale of retail marijuana and retail marijuana products, commencing on January 1, 2018 and increasing by a half percent each year, up to a maximum of 5%; WHEREAS, on November 28, 2017, the Board of Trustees adopted Ordinance 28-2017, codified in Section 3.04.066 of the Eagle Municipal Code, to implement the marijuana tax; and WHEREAS, the Board of Trustees wishes to amend Section 3.04.066 of the Eagle Municipal Code to increase the marijuana tax for 2019. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF EAGLE, COLORADO AS FOLLOWS: Section 1. Section 3.04.066 of the Eagle Municipal Code is hereby amended as follows: Sec. 3.04.066 Levy of special sales tax on the sale of retail marijuana and retail marijuana products. In addition to the regular municipal sales tax described in this Chapter, there is hereby imposed and there shall be collected and paid a special sales tax on retail marijuana and retail marijuana products equal to 2.53.0 percent of gross receipts upon the sale at retail of retail marijuana and retail marijuana products commencing January 1, 20182019. Said rate shall increase 0.5 percent each year thereafter so long as such rate does not exceed 5.0 percent. Section 2. Severability. If any article, section, paragraph, sentence, clause, or phrase of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of Trustees hereby declares that it would have passed this Ordinance and each part or parts hereof irrespective of the fact that any one, or part, or parts be declared unconstitutional or invalid.
